Employer Sponsorship Requirements

Your employer must be an approved sponsor with the Department of Home Affairs before nominating you. This involves background checks, financial verification, and demonstration that the employer is a legitimate operating business with genuine need for your skills. Once approved, your employer nominates you for either a TSS 482 or ENS 186 position.

For TSS 482, your employer must satisfy the Department that there is a genuine skills shortage in your role and that they have actively recruited locally without finding a suitable Australian candidate. For ENS 186, the employer nominates you directly for permanent employment; labour market testing requirements are less stringent than for TSS, though the employer still demonstrates commitment to long-term employment.

Your employer is responsible for meeting sponsorship obligations, including notifying the Department of any material changes to your employment and ensuring you work only in the nominated role. Many employers arrange legal support to manage these obligations correctly.

How to apply, step by step

  1. Confirm the correct ANZSCO code for your occupation. Everything downstream depends on it, and an assessment obtained for the wrong code does not transfer.
  2. Obtain a positive skills assessment from the assessing authority for that occupation.
  3. Meet the English language requirement for the visa you are applying for.
  4. Lodge an Expression of Interest through SkillSelect, claiming only points you can evidence.
  5. If you are seeking state nomination, apply to the nominating body separately and on its terms.
  6. Wait to be invited. You cannot apply for the visa until an invitation is issued.
  7. Lodge the visa application within the period allowed by the invitation, with the evidence for every claim you made.
